Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Day Score application (the "Service") on any platform (Web, iOS, or Android), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must strictly stop using the Service and uninstall the application.

The Service is operated by Axiom Holdings Limited ("Company," "we," "our," or "us"), a company registered in Hong Kong.

2. IMPORTANT: Medical & Health Disclaimer

Day Score is not a medical device and does not provide medical advice. The Service, including all daily scores, meditation tools, journal prompts, and data analytics, is for informational, self-improvement, and educational purposes only. It is not intended to diagnose, treat, cure, or prevent any disease, mental health condition, or physical ailment.

  • Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition or mental health concern.
  • Never disregard professional medical advice or delay in seeking it because of something you have read or tracked on this Service.

3. User Accounts

To access the Service, you must create an account. Regarding your account, you agree to:

  • Accuracy: Provide accurate, current, and complete information.
  • Security: Maintain the security of your password and encryption keys. You accept full responsibility for all activities that occur under your account.
  • Encryption Keys: If you enable End-to-End Encryption, you acknowledge that we do not store your decryption password. If you lose this password, your data is permanently unrecoverable. We cannot reset it for you.
  • Age: You must be at least 13 years old (or the age of digital consent in your country) to use the Service.

4. Subscriptions and Payments

The Service may offer free and paid features ("Premium"). If you purchase a subscription:

  • In-App Purchases: Payments processed via the Apple App Store or Google Play Store are subject to those platforms' terms and conditions.
  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Cancellation: You must cancel via your device settings (Apple ID or Google Play Account). Deleting the app does not cancel your subscription.
  • Refunds: Refunds are handled exclusively by the platform (Apple or Google) according to their refund policies. We do not process refunds directly.

5. User Content and Licensing

You retain full ownership of all content you create within the Service ("User Content"), including journals, scores, and goals.

  • License to Us: By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, process, display, and reproduce your User Content solely as necessary to operate and provide the Service to you (e.g., displaying your journal entry back to you).
  • Prohibited Content: You agree not to input content that is illegal, infringes on intellectual property, contains malware, or promotes self-harm or violence.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, or international law.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app.
  • Use any automated system (robots, spiders, scrapers) to access the Service.
  • Share your account credentials with third parties.
  • Harass, abuse, or harm another person via the Service.

7. Intellectual Property

The Service, including its original content, features, code, design, and functionality (excluding User Content), is owned by Axiom Holdings Limited and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute the Service without our written permission.

8. Third-Party Services and Links

The Service may contain links to third-party websites or services (e.g., Firebase, Analytics) that are not owned or controlled by us. We assume no responsibility for the content, privacy policies, or practices of any third-party services.

9. Apple App Store Provisions

If you download the Service from the Apple App Store, the following applies:

  • These Terms are between you and Axiom Holdings Limited only, not with Apple.
  • Apple is not responsible for the Service or its content.
  • Apple has no obligation to furnish any maintenance or support services with respect to the Service.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce them against you.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
  • NON-INFRINGEMENT.
  • THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
  • THAT DATA (INCLUDING ENCRYPTED DATA) WILL NOT BE LOST OR CORRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXIOM HOLDINGS LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Axiom Holdings Limited, its officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or your violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

  • Upon termination, your right to use the Service will immediately cease.
  • You may request data deletion prior to termination as per our Privacy Policy.
  • Sections regarding Intellectual Property, Indemnification, Liability, and Disclaimer shall survive termination.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes (e.g., via email or an in-app notification). By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.
